1.1 These Warranty Terms govern the warranty for Products purchased by the Buyer from the Seller via the E-store. Please read carefully these Warranty Terms to fully understand your rights and obligations.
1.2 Detailed information on the process of purchasing the Products, payment of the price, delivery, and other related details are provided in the Terms, which can be accessed at https://nidaloghouses.com/terms-and-conditions/. These Warranty Terms, together with the Terms, form an integral part of the Agreement between the Parties.
1.3 The definitions provided in these Terms shall also apply to the Warranty Terms, unless expressly stated otherwise.
2.1 The Seller guarantees that all wood used for the production of the Products is free from insect damage, rot, mold, and has been kiln-dried, all components and component joints of the Products are manufactured precisely as specified in the drawings and are prepared for assembly of the Product.
2.2 The Seller’s warranty, as stipulated in these Warranty Terms, applies to the components of the Product, but not the assembled product as such. If the Buyer engages the Seller for assembly, the warranty also covers the assembly work performed by the Seller. This is because incorrect assembly, improper handling, or failure to follow the provided instructions may compromise the structural integrity and intended functionality of the Product, making it impossible for the Seller to guarantee its quality and durability.
3.1 Despite the care Seller takes in selecting the very best materials for the Products available, wood it’s not as predictable as brick or cold steel. Wood is a natural material that has characteristics and quirks unique to every log. Because the Seller’s wood logs once fed water and nutrients back and forth from its roots to its leaves, its very nature is to be porous and swell up when it gets wet. Any wooden product will do this throughout its life, but there are a few things the Buyer can do to help limit this movement:
3.1.1 Painting: The Seller recommends painting the Products both inside and outside immediately after assembling. This will protect them from the sun and rain and ensure a long lifespan.
3.1.2 Water Repellent Treatment: How the Buyer customizes and decorates their Product is up to the Buyer, however the Seller would recommend that the Buyer uses an appropriate water repellent treatment. This really helps minimize the amount of moisture that wood can absorb, therefore minimizing the risk of any major movement.
3.1.3 Ventilation: Keeping the Product well-ventilated is essential. This is especially true if the Buyer plans to cover up the floorboards with something (the Buyer needs to double check with an expert, that the material is suitable to do so), as moisture can become trapped between layers of non-breathable materials and build-up, leading to floors becoming rotten.
3.1.4 Regular Seasonal Maintenance: Whether the Buyer opts to build their Product themselves, the Buyer doesn’t need to be afraid to tighten the odd bolt here and there. The Buyer’s Product is a life improving investment, so it’s only right to give it some love and care from time to time. The Buyer needs to make sure that it’s properly treated before the rainy months, and the Buyer needs to make adjustments to doors and window frames, when needed. 3.1.5 Natural Wood Properties: after assembling the Product, this natural construction will begin to ‘settle’. This means that the Buyer will likely see some natural wood imperfections appear. These types of natural imperfections can include: cracks, splits, shakes, warping / twisting, expansion and contraction, etc.
4.1 The Seller strongly recommends engaging its assembly services to ensure proper installation of the Products. If the Buyer chooses to assemble the Products independently or with the assistance of third parties, the Seller remains committed to providing a clear and structured support process to assist the Buyer. This ensures accurate guidance and effective communication throughout the process. The following procedure should be followed whenever the Buyer requires assistance during assembly:
4.1.1 Check the Parts: Before beginning assembly the Product themselves or engaging a third party for assistance, the Buyer must verify that all parts included with the Product are complete and in good condition. Conducting this check early helps avoid unnecessary costs or delays.
4.1.2 Read the Instructions: The Buyer should carefully read the entire set of assembly instructions multiple times, if necessary, to fully understand the scope of the task ahead. Proper preparation is essential to ensure a smooth and successful assembly process. It is crucial to fully understand the scale and nature of the assembly project and plan accordingly. This is not a standard flat-pack furniture item; it requires careful thought, consideration, and preparation before beginning.
4.1.3 Spare Components: Each Product is supplied with spare components – main wall logs, roof boards, floorboards and etc.- which will remain unused if no significant defects or damages occur during construction. They are usually marked on the technical plans sheet with the words “EXTRA”.
4.1.4 In Case of Problems, Contact Support: If additional assistance is required, the Buyer must contact Seller’s support via support email support@nidaloghouses.com. The following procedure will then apply:
4.1.4.1 If this is the Buyer’s first-time contacting Seller’s support, please allow 24-48 hours for a response.
4.1.4.2 If no response is received, the Buyer should verify that the email address was entered correctly and check spam / junk folders.
4.1.4.3 Seller’s support will categorize and assign the query to an appropriate team member. While the Seller aims to respond on the same business day, emails received after 5:00 PM may not be addressed until the next working day.
4.1.4.4 If the Buyer is unable to resolve their issue with a Seller’s support representative, they may request an escalation to a Seller’s support manager.
4.1.4.5 Seller’s support managers work closely with their teams and senior management to ensure the highest levels of service.
4.1.4.6 Seller’s support managers continuously monitor and advise the Seller’s support team and may take over direct communication when necessary. This process also helps with ongoing training to enhance service quality.
4.1.4.7 If the issue remains unresolved after engaging with the in-house Seller’s support team, the Buyer may request the contact details of a Seller’s director to submit a formal letter.
4.1.4.8 The letter will be reviewed by the Seller’s director but is often delegated back to the Seller’s support team for resolution under their guidance.
4.2 The Buyer must follow the structured above-described request for support process sequentially, ensuring all listed steps are exhausted before pursuing any further actions. The Seller’s support team is committed to addressing and resolving inquiries efficiently. To maintain an organized and effective response system, the Buyer should not expect immediate direct communication with a Seller’s support manager or a director upon first contact.
5.1 Unless specified differently on the E-store, Products purchased by the Buyer-consumer are subject to a standard statutory 2 (two) years warranty for product quality. The Seller also provides 2 (two) year commercial warranty for Products purchased by the Buyers-entrepreneurs.
5.2 The warranty period starts at the time Products are delivered to the Buyer, or when the Buyer signs the document that confirms the delivery of Products, or on forms provided by the delivery personnel.
5.3 If Products are repaired or replaced during this warranty period, it does not extend the original warranty period nor does it start a new warranty period. Any parts replaced or repairs made as a solution to a defect in Product will be covered under the original warranty, which will expire concurrently with Product’s warranty. Should the law mandate different warranty conditions, those legal requirements will take precedence.
6.1 Products should be purchased directly from the manufacturer UAB “MEDŽIO FABRIKAS NIDA” (Seller), and the end user whether a Buyer-consumer or Buyer-entrepreneur needs to own Products before making any warranty claims.
6.2 Under no circumstances may the Buyer make any claims regarding the delivered Products after they have been processed, reworked, transported from the delivery location, or sold to third parties, whether by the Buyer or a third party acting on their behalf.
6.3 The Buyer is responsible for ensuring that Products are used according to their intended purpose and are suitable for the intended construction and operation at their designated location.
6.4 If the Buyer identifies any discrepancies in Products’ quality, quantity or type after their delivery, they must contact the Seller within 14 (fourteen) calendar days and inform them about the discrepancies using the phone number or email address provided on the website of the E-store.
6.5 If the Buyer identifies any defective components during the pre-construction inspection, the Buyer’s warranty claim will not be accepted if the Product’s components have already been used, potentially damaged during construction, or painted. In such cases, it is assumed that the defects occurred during the construction process, and the Seller is not liable. The components will then be ordered and replaced only upon payment.
6.6 All components of the Products, including fasteners, drawings, and specifications, have been carefully inspected and packaged by the Seller. If the Buyer is assembling the Product themselves or hiring a third party for this purpose, the Seller strongly recommends verifying the completeness of all received components against the specification provided with the drawings. These documents are either included in the package or sent via email to the address provided by the Buyer. This inspection must be completed within 14 (fourteen) days of delivery. Any discrepancies should be reported to the Seller before construction begins to ensure timely resolution.
6.7 The warranty shall only apply in the event of defects in Products during the warranty period that are not due to improper use or storage by the Buyer.
6.8 The warranty is valid only if the Buyer has followed the installation instructions when installing the Product. Any modifications to the Product’s design made by the Buyer after delivery are the Buyer’s responsibility, and the Seller is not liable for them and the warranty will be void.
6.9 A warranty event is identified as either a potential flaw in Products design, a defect, or a missing component.
6.10 To submit a warranty claim, the Buyer should provide the Seller with photographs showing the defect, a description of the issue, Product’s name, and any other pertinent details regarding Product.
6.11 Upon receiving a warranty claim, the Seller shall assess the provided information and determine whether the issue qualifies as a warranty case. The Seller will notify the Buyer of its assessment within 14 (fourteen) days from the date of receiving all necessary details.
6.12 In cases of uncertainty, the Seller may extend the investigation beyond 14 (fourteen) days and may choose to consult experts to verify whether Products were assembled according to the provided instructions and whether it meets the conditions specified in these Warranty Terms that could void the warranty. The Seller will inform the Buyer of any conclusions as soon as possible.
6.13 During the warranty period, the Seller’s responsibility is limited to addressing defects in the Product as specified in the Terms; both the Buyer and the Seller agree to follow the procedures outlined herein and these Warranty Terms to resolve any warranty-related issues as smoothly as possible.
7.1 The warranty does not cover defects, damages, or claims arising from the following:
7.1.1 Natural properties of wood:
7.1.1.1 Wood is a natural material and may exhibit variations in shade, texture, grain direction, and knots, which are not considered defects.
7.1.1.2 Small cracks and gaps from drying that do not affect structural integrity.
7.1.1.3 Slight warping, twisting, or bending of wooden parts, provided they remain functional.
7.1.1.4 Natural expansion and shrinkage (up to 5% of width and thickness) due to temperature and humidity changes.
7.1.1.5 Resin pockets, sound knots, and black knots in structural components.
7.1.2 Buyer-induced modifications and improper treatment:
7.1.2.1 Painting, varnishing, or impregnation done by the Buyer.
7.1.2.2 Modifications to the structure, including design changes, partitioning, insulation, or any alterations not foreseen in the original design.
7.1.2.3 Failure to apply wood treatment (preservative, oil-based paint) inside and outside within 14 days of assembly and annually thereafter.
7.1.2.4 Not using cut-end treatment after cutting, drilling, or piercing wooden parts.
7.1.2.5 Objects permanently attached to walls, interfering with normal wood movement (e.g., drying, shrinking, expansion).
7.1.2.6 Failure to ensure adequate weather protection, such as missing storm braces, roofing straps, or fastening strips.
7.1.3 Errors in assembly, including:
7.1.3.1 Not following the provided instructions.
7.1.3.2 Failing to install a moisture barrier between the foundation and the structure.
7.1.3.3 Not ensuring the lower frame is level and square before installation.
7.1.3.4 The first row of walls extending beyond the foundation’s edge by more than 5 mm.
7.1.3.5 Improperly installed foundation leading to subsidence or structural instability.
7.1.3.6 Failure to adjust hinges when doors or windows expand or contract due to natural wood movement.
7.1.4 Roofing issues, including:
7.1.4.1 Improper installation of roofing felt or covering, leading to moisture ingress.
7.1.4.2 Using heavy roofing materials not suited for the structure.
7.1.4.3 Failing to install under-roofing material, if included in the kit.
7.1.5 Improper use, storage and environmental exposure:
7.1.5.1 Storage in damp or unsuitable environments before or after assembly.
7.1.5.2 Failure to protect the Product from environmental factors (sun, rain, frost, humidity).
7.1.5.3 Placing the Product in contact with trees, plants, or walls, leading to excess moisture absorption.
7.1.5.4 Poor ventilation, causing moisture-related defects such as mold.
7.1.5.5 Use of wooden doors in high-humidity areas (e.g., bathrooms, saunas), leading to warping or expansion.
7.1.6 Handling and external damage:
7.1.6.1 Mishandling, such as doors being caught by wind, resulting in broken hinges or cracks.
7.1.6.2 Damage from objects attached to walls, impairing normal wood movement.
7.1.6.3 Mechanical damage to glass components, including breakage due to pressure, thermal effects, or impact.
7.1.6.4 Minor transport damage that does not affect functionality, especially if it can be repaired (e.g., patching wood holes).
7.1.6.5 Defective parts that were assembled or painted, despite defects being noticed before installation.
7.1.7 External factors and unforeseen events:
7.1.7.1 Storms, lightning, floods, fire, frost, and other natural disasters.
7.1.7.2 Condensation from temperature changes causing staining or mold.
7.1.7.3 Vandalism or accidental damage.
7.1.7.4 Power supply malfunctions related to accessories.
7.1.7.5 Force majeure events (e.g., floods, storms, fire, tornadoes).
7.1.8 Other exclusions:
7.1.8.1 Claims made by someone other than the original Buyer.
7.1.8.2 Failure to provide sufficient or accurate information about the warranty issue.
7.1.8.3 Obstructing the Seller’s representatives from inspecting the Product.
7.1.9 Characteristics of wood that are not considered defects:
7.1.9.1 Colour tone variations due to the natural structure of the wood.
7.1.9.2 Minor drying cracks that do not compromise strength.
7.1.9.3 Twisted or slightly bent components that remain functional.
7.1.9.4 Knots, resin pockets, and small imperfections that do not affect stability.
7.1.9.5 Unfinished surfaces, minor irregularities, or rough edges on non-visible parts.
8.1 The Seller reserves the right to modify these Warranty Terms. In such an event, the Seller will notify you by updating the Warranty Terms on the E-store or through other standard communication methods. Any updates or changes to the Warranty Terms will apply only to Products purchased after the updated Warranty Terms are posted on the E-store.
